The preliminary hearing in which the court chooses between rival applicants for the right to prosecute, decided without witnesses or documents — hence the name, a judgement reached by divining.预审：数人争为起诉者时，法庭于其间择一之程序；此审不传证人、不阅簿册，故名预断。
